Recordkeeping Exemptions

Some companies may be exempt form certain OSHA recordkeeping requirements based on their size (number of employees) or their industry classification (NAICS).  


If your company had 10 or fewer employees at all times during the calendar year you do not need to keep injury and illness records unless OSHA or the BLS informs you in writing that you must keep records.  


If you business establishment is classified in a specific industry group listed in Appendix A of the OSHA Recordkeeping Standards 29 CFR 1904 you do not need to keep injury and illness records unless OSHA or the BLS informs you in writing that you must keep records.


It is important to note that these exemptions do not eliminate the requirement that all employers must report to OSHA any workplace incident that results in an employee's fatality, inpatient hospitalization, amputation, or loss of an eye.
